Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Rax (“we”, “us”), an unincorporated sole proprietorship based in Florida, USA, and the operator of Trawl at trawln.com (the “Service”). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. The Service

Trawl is a sales-research tool. It returns businesses matching a user’s search, together with publicly available information about them and a score estimating commercial opportunity. Users may save businesses as leads and track them through a pipeline.

The Service provides information only. We do not contact businesses on your behalf, we do not represent that any business consents to being contacted, and we do not guarantee any commercial outcome. You are solely responsible for your use of the information the Service provides.

2. Accounts and eligibility

You must be at least 18 years old to use the Service. You must provide accurate registration information and keep your credentials confidential. All activity under your account is attributed to you. Notify us promptly at [email protected] if you believe your account has been accessed without authorisation.

Accounts are personal to one user. You may not share credentials, resell access, or operate the Service on behalf of third parties without our prior written agreement.

3. Plans and usage limits

The Service is offered in three tiers:

All allowances are enforced on our servers and are subject to short-term rate limits. Re-running the same search terms within ten minutes with a different area or distance is treated as a refinement of that search and is not counted again (up to four refinements per search). Reaching a limit suspends the relevant feature until the allowance resets; it does not incur additional charges. Automated or scripted use is prohibited under Section 5. We may adjust limits where underlying costs change materially; existing subscribers will receive notice.

4. Fees and payment

Paid plans are subscriptions billed in advance, monthly or yearly, through our payment processor, Stripe. Yearly plans are discounted 12% relative to monthly billing. We do not receive or store full card details. Prices are in US dollars and exclusive of applicable taxes.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from Settings; cancellation takes effect at the end of the period already paid for. Refunds are governed by the Refund Policy, which is incorporated into these Terms.

If a payment fails, we may retry it and may suspend or downgrade the account while it remains unpaid. Data is not deleted for non-payment; the account reverts to the Free tier and its limits.

We may change prices with at least 30 days’ notice by email to existing subscribers. New prices apply from the next renewal.

6. Third-party business data

Business information displayed by the Service — names, categories, phone numbers, ratings, review counts, opening hours, street addresses and website addresses — is sourced from the Google Maps Platform. Website performance measurements are sourced from Google PageSpeed Insights. Your use of that data is additionally subject to Google’s terms. In particular:

We do not verify third-party data and make no representation as to its accuracy or currency.

7. Scores

Lead scores and website scores are our own estimates derived from public signals. They are not statements of fact about a business, not an assessment of its quality or creditworthiness, and not advice of any kind.

8. Your content

You retain ownership of the content you create in the Service — notes, pipeline stages, reminders and call logs. You grant us a limited licence to host and process that content solely to provide the Service. We do not sell it and do not use it to build products for others.

You may delete your data at any time and may request a copy of it, as described in the Privacy Policy.

9. Intellectual property

The Service — including its software, interface, scoring logic, name and mark — is owned by Rax. A subscription grants a limited, non-exclusive, non-transferable right to use the Service. It grants no other rights.

10. Availability and changes to the Service

The Service is provided without an uptime commitment. It may be unavailable due to maintenance, failures at the providers it depends on (Supabase, Cloudflare, Google, Stripe), or events outside our control. We may modify or withdraw features; where a change materially reduces what a paid plan provides, subscribers will receive notice by email.

11. Term and termination

You may stop using the Service and delete your account at any time. We may terminate this agreement with 30 days’ notice, or immediately on material breach of these Terms. If we terminate without cause during a paid period, the unused part of that period is refunded.

Deleting your account cancels any subscription on it immediately, and the unused remainder of the paid period is forfeited. To use the remainder of a paid period, cancel from Settings first and delete the account when the period ends.

On account deletion, account data is deleted immediately, except records we are legally required to keep, such as invoices held by our payment processor.

12. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and any warranty that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, we are not liable for lost profits, lost business, lost data, or any indirect, incidental, special, or consequential loss. Our aggregate liability for all claims arising out of or relating to the Service is limited to the greater of the amounts you paid us in the 12 months preceding the claim, or USD 100.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.

13. Indemnification

You will indemnify Rax against claims, damages, and reasonable costs, including legal fees, arising from your use of the Service, your outreach to businesses, or your breach of these Terms or of applicable law.

14. Changes to these Terms

We may amend these Terms. The date at the top identifies the current version. If an amendment materially affects your rights, we will give at least 30 days’ notice by email before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms; if you do not accept them, cancel before the effective date.

15. General

These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder remains in effect. A failure to enforce a provision is not a waiver of it. You may not assign this agreement. We may assign it in connection with a sale or reorganisation of the business; your rights under it are unaffected by such an assignment.

16. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Florida have exclusive jurisdiction, except that if you are a consumer you may bring a claim in the courts of your place of residence.
